“UNLAWFUL INTAKE PRACTICES – Violation of CMS Regulations for Dual-Eligible Patients ​ Changing Minds Psychiatry attempted to violate federal and state CMS regulations during my intake process. I called their office to establish care for ketamine-guided therapy—specifically looking to utilize the esketamine nasal spray (Spravato)—and confirmed that this clinic is covered as an in-network provider under my Anthem dual plan. ​When trying to schedule the appointment, the front desk aggressively insisted on keeping a credit card on file to charge in the event of a missed appointment. For background information for anyone reading this, I have been a paralegal for 17 years and have been on disability for almost 20 years (18 years). Because of my extensive legal background, I know patient rights and compliance regulations inside and out. ​As a dual-eligible Medicare/Medicaid beneficiary, this credit card practice is a direct violation of compliance rules. Medicaid guidelines strictly prohibit providers from balance-billing or creating financial barriers like missed appointment fees for beneficiaries. When I called out this policy and refused to provide a credit card, they refused to schedule me. ​For a medical facility to enforce non-compliant financial policies that prey on patients unaware of their rights under CMS guidelines is a massive red flag. If their billing department is pushing illegal boundaries before a patient even walks through the door, it signals a severe lack of operational compliance and ethics from the top down. Avoid this clinic if you expect legal, ethical, and professional medical care. ​I actually was able to get help with Nevada mental health and they are very compliant and they were shocked when I told them about what I had just experienced in the prior call.”
